Driver: New Stricter Standard Established for PFOA and PFOS, in California
Feb. 6, the state of California lowered the acceptable levels for two PFAS toxins in drinking water (10 parts per trillion (ppt) for PFOA and 40 ppt for PFOS) under AB 756: California’s Regulatory Response to PFAS. Previously, the RL was 70 ppt for the total concentration of the two contaminants combined. This action triggered the closure of wells all over California. Orange County, the most affected area, expects a third of the 200 groundwater wells in its service area shut down by year’s end because of the presence of toxic PFAS. Nine of those wells have already been closed.
Driver: H.R. 535 - PFAS House of Representatives Legislation
At the end of 2019, the Department of Defense’s authorization bill (the National Defense Authorization Act or “NDAA”) and government-wide appropriations bills were passed by Congress and signed into law by the president. These bills included important PFAS-related provisions.
The House of Representatives was of the opinion that the 2019 legislation did not go far enough to address PFAS issues. Hence, they passed the H.R. 535, omnibus-PFAS legislation, in January 2020. This is an ongoing matter.

Driver: H.R. 4031 - An Act to Amend the Federal Water Pollution Control Act to reauthorize the Great Lakes Restoration Initiative, and for other purposes
This legislation adopted by the House of Representatives, authorizes funding the Great Lakes Restoration Initiative at levels escalating to $475 million annually in 2026.

Driver: The Navigable Waters Protection Rule (NWPR)
Jan. 23, The Navigable Waters Protection Rule was finalized by EPA and the Army to define “waters of the United States” (WOTUS). This new definition of WOTUS includes four simple categories of jurisdictional waters. It also provides clear exclusions for many water features that have not been regulated, and defines previously undefined terms in the regulatory text. The final rule fulfills Executive Order 13788.
The NWPR details how the Clean Water Act (CWA) will be enforced, including which waters receive federal protections under the act.

- Jan. 6, 2020, Expedition Water Solutions Colorado LLC announced its acquisition of water infrastructure assets from an undisclosed seller. The transaction included two saltwater disposal facilities which collectively offer more than 25,000 Bbls/day of permitted capacity in the core Wattenberg area of the DJ Basin.
